Here I am

Here I am,
Looking back in life
when I didn't know the difference between
good or evil; truth or lie,
smiling at everyone, whoever passed by..

I played with sand, made my castle,
and cried when somebody broke it..
a small hug from mom then,
always motivated me to build the castle again..

Here I am,
Looking back in life
when a small candy was the biggest gift,
and a doll was like a sibling..
the fights with friends lasted for five minutes,
what is ego? I didn't know..

When ambitions in life changed every second,
from doctor, to astronaut and engineer.
When I didn't need a reason to laugh,
One smile solved every problem.

Today things are the same, but I have changed,
I don't laugh without a reason,
Nor do I have multiple ambitions..
I no longer make castles, nor get anymore candies,
Nor do I have any dolls to talk to.

But I still have the power,
Power to love unconditionally,
and live the life that of a kid,
and I have the power to rebuild my castle,
the sand is the same, the motivation is still there..

Here I am,

Have we changed?

On this day one year before, Mumbai witnessed one of the darkest periods in its history that lasted for 59 long hours. So many people lost their lives; the whole country protested. For one whole week, we all were furious. But after that, things were back to normal. We all became busy once again in our so called fast lives, too occupied to notice what is happening around us. How come Kasab is not yet punished? How come the file and the bulletproof vest which were the prime evidences in the 26/11 case went missing all of a sudden? How come the same ministers are still ruling the state? Wearing white today only because few smses are doing rounds – will that solve our problem? What have we learnt from so many terror attacks that we have witnessed so far?

My rage is not coming out without any reason. An incident happened yesterday that really shook me and made me wonder whether we will ever change. While travelling in the local train, I spotted a parcel around 6 feet long and wrapped in black plastic on the luggage rack. I found it a bit fishy and asked people if that belonged to any of them, but nobody answered. I threatened them saying I would pull the chain as soon as we reach the next station and call the police if nobody is the owner of it. One lady with a kid immediately told me that it belonged to her. I demanded to see it, she refused saying that I am absurd as I am doubting a hindu maharashtrian lady travelling with a kid. I again threatened her that I would call the cops if she is not going to open that parcel right away. She opened the bag, and there were few wooden sheets inside which I don’t understand why she was hiding from us.

Everyone appreciated my move later, but nobody had bothered to pay any attention to that parcel lying above their head. Every day we hear so many announcements made on railway stations about noticing unattended and suspicious looking parcels, but do we ever bother to check the luggage rack or the area below our seats before taking our seats in the train? Do we ever observe people around us while travelling, walking, or even when we are waiting for somebody? So easily we forget the 11/7 train blasts, 26/11 blasts and many other similar incidences. We show our rage, attend rallies, wear whites, protest, shout, blog, appreciate the spirit of people; but that’s that. What do we actually do to prevent such incidences? Are we responsible enough to take things in our hand and start noticing things? Are we too busy to save our own life? Only because people who lost their lives were not our family members, we can afford to be ignorant? For how long we are going to play the blame game?

I request you all to read the posts mentioned below by few bloggers who lost their family members; who still feel for the country the same way they felt when such incidences took place. Maybe one of you will feel the same pain like they do; maybe one of you will vow to take things in one’s own hands by taking responsibility of our own country ans for the sake of your own life.

Guess who am I?

Whoever invented mobile phones, and especially the caller id feature on it must be a “pathetic at recognizing voices” soul like me. And all the credit goes to those aunties around us who always call up on the land-line and ask the same question each time – "hello beta, pehchana muje? Guess who am I?" 

You become their favourite and get the warmest (read bone breaking tight) hug from them if you guess their name right. But if at all your day is bad and your guess work fails you, then god save you from their taunts, their slaps which they pretend as if they have come out of affection for you and a long lecture about the stupid most thing so that you register their voice in your mind forever.

Yes you guessed it right. I have been that unfortunate victim so many times. It was all still fine before marriage. My guess work was comparatively better too than now; for i knew most of my mum’s friends and relatives properly. So it was most of the times easier to get their name correct after talking to them for two minutes.

But post marriage; oh my, it is catastrophic if at all you fail to recognize the caller and god bless your soul if the caller happens to be a relative! I once failed to recognize one of Mandar’s aunt; and till date she greets me with a taunt – "beta, aawaz to nahi, shakal to yaad hai na ya wo bhi aap bhul gaye? (you don’t recognize my voice, but do you at least remember my face or you have forgotten that too?)". Oh I forgot to mention one thing – at the time of this incident; I was talking to this aunt in law for the first time over the phone!

There is one more thing I am pathetic at – remembering faces. It takes me quite some time to register a particular face I have seen only once before. So many seasonal (you see them only in weddings) relatives end up asking me whether I know them or not. Most of the times I get away with a lie that I remember them; but certain species cross-check too – if you remember me; then tell me how am I related to you? And I am speechless!

My trouble does not end here people. Apart from being bad at remembering faces and recognizing voices, I am really very bad at guessing a person’s age, noticing obvious (?) changes in his/her physique, complexion, hair cut etc. Even if you reduce 20 kgs and come in front of me, I won’t know the difference. Imagine the trouble this must have put me into – especially with my mother in law. She once went to the gym regularly for two months and reduced good 8 kgs; and i failed to notice that. Ah, that time she didn’t speak with me for two days and kept throwing her weight around all the time.

Another Aunt came and asked me – guess my age. I looked at her and thought she looked around 50, so to be on a safer side, i gave my flashing smile to her and said “Aunty, you look like a 40 year young lady.” She turned out to be 36. Now i always maintain one answer for all for this question – 30 years if I spot a bit of gray on their head and 20 if their hair is dyed. 

I am still looking out for the solution for saving myself from the trouble of recognizing voices and registering faces all the time!

Freedom of Press

Those Doordarshan days, when it was fun to watch a few serials on weekdays; epics and cartoons on a Sunday and News at 9 without fail each day. Half an hour and all the happenings in the country – from politics to economy, from entertainment to sports and weather reports – were reported by those few familiar faces. Next morning, the news was the first topic of discussion with neighbours, friends and office colleagues.

These days with 20 odd 24x7 news channels making a gossip like “aishwarya rai sneezed this morning at 9:37 am” a breaking news – exclusively for you; the media has become a joke. They have special programs on what is happening in the daily soap world, who is shooting for what; who fainted on sets; whose affair is with whom etc news to carry out each day for half and hour and repeating the same telecast at least twice or thrice a day. Hardly anybody takes any news seriously now. Hardly any discussion happens over tea or anytime about most of the reports on the news channels; we suspect most of the reports shown with the mindset that the channel must have made it up to increase its TRPs. Well they have all the rights to feature what they want to feature, for our Constitution of India has given them a right to Freedom of Press.

The Constitutional Provision:

Freedom of the Press has not been expressly provided for in the Constitution, but is implicit in the Fundamental Right pertaining to the Freedom of Speech and Expression guaranteed to the citizens under article 19 (1) (a) of the Constitution of India. The term "Freedom of Speech and Expression", includes the liberty to propagate not only one’s views but also the right to print matters which have been borrowed from someone else or are printed under the direction of that person and also includes the liberty of publication and circulation. Every right carries with it a responsibility. Likewise, every freedom carries with it an obligation. It is primarily for the Press itself to determine what are its corresponding responsibilities and obligations.

My question is – are most of these news channels using this power wisely and fairly? Ample number of incidences whereby the fight to win the top spot among 20 odd existing news channels misused this power and didn’t try to understand the gravity of the situation.This resulted into:

• 59 hours of struggle at the time of Mumbai Terror Attack on 26/11: the inside out report about the plan of our police, military and fire brigade plans and positions helped the terrorists to fight longer at the time of 26/11 terror attack;

• Adnaan Patrawala case: a Mumbai boy was kidnapped by his friends. The news of his kidnap got leaked in the media somehow. All the news channels flashed it, because of which the kidnappers got panicked and because of the fear of getting caught, they murdered him.

• The famous Arushi murder case: whereby her father was a suspect in her murder. Media people constantly shooting each expression of the couple, pestering them to give an interview, without once thinking about what they must be going through.

And many more such cases...

The press has been useful too on many occasions, but the damages caused because of their so called Exclusive Reports cannot be compensated either. How many times you have seen a reporter shooting a fight between two people? Do you ever wonder why he never went to stop them? Rather he kept shooting until one or both of them had to be hospitalized and the channel claimed that we were the first one to report this.

Haven’t sting operations conducted by the tv channels violated the right to privacy? No doubt they were useful, but they framed innocents too, making their life miserable there after and damaging their reputation forever.

I want to love the press, but i want to love the responsible press that knows its duties, understands the sensitivity of the situation and acts within its limitations for the benefit of public and not TRP, sponsors, number one spot and revenue only. I do not mind 20 different 24x7 channels, but i do want to see sensible news there.

Please Help me!!!!!

People I am suffering; suffering from an age old problem, but nobody takes me seriously. Be it my friends, family or my professors. After completing my Law, I thought I had got rid of that disease, but no; it is still behind my life. I tried to explain this to my professors, but they threatened me saying that they would fail me in the year if I don’t follow the rules properly. My god, can’t they spare a poor and ill soul like me? Oh yes, ill soul; for I have been a lecturophobic since my 5th standard. I cannot attend any kind of lectures; they suffocate me and depress me.

And friends, this is not the only problem. I respect my mother and the values she has nurtured me with; but my professors are forcing me to disobey it all. Mum always taught me never to insult my near and dear ones. But these professors make me insult one of the dearest things – my sleep. Oh yes, they force me to get up as early as 6 am and attend the lecture that starts sharp at 7.30 am. Sorry mother, I am not able to follow what you always taught me; but I am still trying my best. I do not completely insult my sleep. I make sure to snooze the alarm at least three to four times before getting up. My professors yell at me for being late; but your word matters more than their yelling.

And above all, I have been instructed to make four projects without any help from google (yes) within one week; and present them in class. Oh lord, why didn’t you make the lecturophobia and projectophobia the official diseases? Is anybody doctor here? Please contact me; we will file a petition and make them legal.

I hope you all can understand what I am going through right now from the quality and content of this post. Please help me fight the management and the rules that make me force my mother’s commands. I want to file a PIL against them right now.

The Surprise Day

Certain things happen in your life that you can’t help but to flaunt in front of people. I had such an amazing day too, on children’s day. After two and a half years, I finally received my Law degree Certificate – it is called a Sanad. Now we all are already thinking about where to display it? Which wall will be the most appropriate one? Accordingly, we will select the frame. Oh yes, we are going to display that. It was one of the best moments of my life – a dream come true.

(thanks to our post service, the certificate already has wrinkles, but it is in one piece thankfully)

Second surprise of the day – my holiday finally got finalized. We got all the bookings done, as we wanted; with no adjustments on dates, leaves and staying arrangements. So a well deserve break on cards confirmed now.

Third Surprise – my post on Public Interest Litigation got picked up by blogadda for their Spicy Saturday Pick. Well, I really appreciate their gesture; as I have not even pasted their badge on my blog. But nevertheless, I am thankful to them for giving an important post that place. I feel we all should have basic knowledge of the legal rights and benefits available to us.

Another good thing happened was that I spent the weekend at mum’s, with the whole family and the new member around – my niece. Now she has started to express her various emotions – happiness, anger, frustration, dislike and her love for music. Play something all the time and she is happy and singing alongwith.

And last but not the least – can there be a more apt post for the 50th post? Yeah, it is my 50th post; and thanks to all my blog friends that I am writing this post. Your feedback is the biggest encouragement for me. It helps me keep going. Thank you and awaiting many congratulations!!

Public Interest Litigation - an Overview

DISCLAIMER: THIS POST IS BASED ON A LEGAL TOPIC - A SUMMARY OF A VERY VAST SUBJECT MATTER IN ITS SHORTEST POSSIBLE FORM. THOSE WHO DO NOT WISH TO READ IT, CAN SKIP THE CONTENT AND READ THE POST SCRIPT OF THIS POST.

Public Interest Litigation – most of us are aware about this term, but very few know the actual meaning of it. Public Interest Litigation, or popularly known as PIL was started to protect the interest of the public in general. Prior to 1980’s, only the party affected directly due to any wrong doing could seek justice in the court of Law. Any other person or party who was not directly and personally affected could not file a suit. This most of the times resulted into violation of fundamental rights guaranteed by our Constitution of India; and this rule affected the socially and economically weaker section of the society more. Thus, Supreme Court of India gave all individuals in the country and the newly formed consumer groups or social action groups, an easier access to the law and introduced in their work a broad public interest perspective.


~~ A PIL can be filed when the following conditions are fulfilled:

1) There must be a public injury and public wrong caused by the wrongful act or omission of the state or public authority.

2) It is for the enforcement of basic human rights of weaker sections of the community who are downtrodden, ignorant and whose fundamental and constitutional rights have been infringed.

3) It must not be frivolous litigation by persons having vested interests.


~~Any person can file a PIL provided:

* He is a member of the public acting bona fide and having sufficient interest in instituting an action for redressal of public wrong or public injury.

* He is not a mere busy body or a meddlesome interloper.

* His action is not motivated by personal gain or any other oblique consideration.


~~ Against whom Public Interest Litigation can be filed?

A Public Interest Litigation can be filed against a State/ Central Govt., Municipal Authorities, and not any private party. The term “State” includes:

• The Government and Parliament of India

• The Government and Legislature of each of the States

• All local authorities

• Other authorities within the territory of India or under the Government of India.


~~ How to file a PIL?

A PIL may be filed like a write petition. Writ Petition is a request made to government or any other authority like court to pass a written order on the subject matter.

A Day with Her..

After a long hectic week, and a lot of running around round the clock due to various reasons; and lack of sleep, I finally took a break today and decided to go to mum’s to catch up with her, have food made by her (nothing beats that, I realised it post marriage), meet my niece, sleep and back to in laws.

I reached mum’s place at around 10 in the morning. There along with usual faces, a smiling and most adorable face greeted me. Oh i had so forgotten how beautiful she is, for so far whenever i went to mum’s, she was sleeping most of the time, and today she was laughing, playing, making noise and welcoming me like she was waiting for me all along. With all tiredness gone, I start playing with her like a kid.

An hour passed in making different funny faces, cuddling, laughing and i realised all this while she was holding my index finger. She loves doing that. She will hold you so tight and with so much of warmth, that you don’t feel like leaving her and going away. I had to send some mails, so i started doing my work, with her lying next to me. Our princess started missing the attention, so she punched herself and started crying really loudly. I freaked out, but mum said it was one of her traits to grab attention, the same thing i did too as a kid. So again the whole attention is on her, the same playing, laughing and cuddling start.

Can anybody leave her and go if she holds you like this?

12:30, she becomes really restless, I am once again provided with another piece of information – it is her massage time and the lady who does it is late. Bhabhi, mum and i are trying hard now to make her smile and she is making all possible faces and throwing tantrums. The lady arrives ten minutes later, and madam is all ready to get pampered. I get really scared by looking at the way that lady is massaging her, and this girl is all silent, enjoying it thoroughly, giving a lazy smile once in a while, almost ready to sleep.

Mum warns me that she hates taking a bath. The moment water touches her body, the whole building knows that she is getting soaked in hot water, she is that loud.just before entering a bathroom, she gives me another smile, as i am following her all the way there. She has taken bath, without crying even once – first time ever. For two minutes, we all are wondering whether she did it purposely to prove these people wrong in front of me. Well at least that is what her smile conveyed. Ah you tend to think on these lines if you have a kid at home na; for that matter, anything is possible.

She goes off to sleep, so do I. She gets up at 4, I am still sleeping; so bhabhi leaves her in the other room. Madam is now missing her usual place where she plays everyday, and since I am sleeping there, bhabhi ignores her tantrums. She is making faces once again, looking all sad and helpless. Mum cannot see it and wakes me. She comes next to me now, and the usual playing and smiling start.

Another hour passes by, and I have to leave now. She is not leaving my hand. The moment i get up, she becomes all sad; when I sit and hold her hand, she plays, not smiling at all. I want to leave after seeing her smile once, but all in vain. Another half an hour passes like that and I finally manage to make her smile once – a small one though, but that is enough for me to leave from there all happy happy.

Critics and Criticism - my weirdness continues...

A holiday is a blog hopping day for me; my passion for reading always takes me to different places thanks to the user-friendly format of our blogger. This is something most of us do during our free time, and we do this more frequently during our initial blogging days to know what people write about, how they write; most of the bloggers are avid readers who after reading a particular piece think about how they would have written it, or even if they find the article appropriate, still they tend to find some room for improvement there. Few who voice out and write about that point of improvement are our critics whom most hate.

Coming straight to my point, while blog-hopping, I have come across many famous blogs, for they have 1000+ followers, 400 to 500 comments each posts, all raving about how much they love that blog, blogger and the posts whether it makes sense or not; at least it didn’t to me, whenever I read them, not once but many times. Me and my biased mind playing tricks I guess because every time I find these people over-rated; my reason being – they always criticize everything, there is not a single positive thing written about anything and anybody, their success mantra I guess or rather, their success preservation mantra. Any which ways criticism is good but criticizing for the sake of it, or to gain publicity, and people supporting it is, well, nothing but encouraging them to write off more and more people; and sometimes good people.

Come to think of it, I am actually weird in this case. Well my regular readers who read my post last month know that by now, but those who are new here, please click on WEIRD to read that post. Back to why I call myself weird once again, well I have never been a fan of people on top, be it in any field – mostly in sports. I am not a great fan of Sachin Tendulkar, though I do like his game; I have been Rafael Nadal’s fan since long time, and I keep criticizing Fedex; I liked Ryan Giggs and Roy Keane more than Roonie or Ronaldo; I have never liked Shobha De’s write up much, as I find her criticizing more than writing happy things, I have never been an Amitabh Bacchan or SRK fan, I prefer a test match over a 20-20 as it lasts long, etc. etc. the list goes on and on. So I believe here too, my weird (or sadist? Hope not) belief works, thus I am not a fan of amazing write ups, but well, what to do, I can’t read the awesome most write ups if they are wrongly criticizing others for the sake of it; so what can I do? Well what I have been doing for so long – read, sigh, decide never to go back those blog pages, but still go back there. When will my weird mind actually accept that most of the famous writers are not over-rated? Very few deserve that title and 1000+ followers?

These are purely my views and I have not written this to hurt anybody’s sentiments. I am still learning in this blogger’s world, maybe this is the reason I do not like those amazing blogs so much; why amazing? They have so many followers and comments; it cannot be for no reason at all right? So something is wrong with me only, and my mind being biased and hopeless and above all weird; I don’t think I will be able to bring myself to read them in near future.
